Welcome to Intimates.no! By accessing or using our platform, you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using the Platform.

1. Acceptance of Terms

These Terms govern your use of Intimates.no, which provides a marketplace platform where Sellers can post advertisements for physical and digital products, and Buyers can purchase these products. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Definitions

  • User: Any individual or entity that accesses or uses Intimates.no.
  • Seller: A User who creates and posts advertisements for products on the Platform.
  • Buyer: A User who purchases or expresses interest in purchasing products listed on the Platform.
  • Content: All text, images, videos, and other materials posted on the Platform by Users.
  • Services: The functionalities provided by Intimates.no, including but not limited to user registration, marketplace access, messaging features, and transaction facilitation.

3. User Accounts

To access certain features of the Platform, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account or any other breach of security.

Intimates.no reserves the right to suspend or terminate accounts that violate these Terms or that engage in fraudulent or abusive activity.

4. User Conduct

You agree to use the Platform in accordance with applicable laws and regulations. You are prohibited from:

  • Posting any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Engaging in any fraudulent or deceptive practices, including but not limited to impersonating any person or entity or misrepresenting your affiliation with any person or entity.
  • Using automated means, including bots or scrapers, to access the Platform for any purpose without our express written permission.
  • Disrupting the operation of the Platform or attempting to gain unauthorized access to any systems or networks connected to the Platform.

5. Marketplace Transactions

Intimates.no facilitates the connection between Buyers and Sellers but is not a party to the transactions conducted between them. All transactions are made solely at the discretion of the Users involved. By using the Platform, you acknowledge and agree that:

  • Intimates.no does not guarantee the quality, safety, or legality of items sold.
  • Intimates.no does not guarantee the truth or accuracy of listings, and Sellers are solely responsible for their Content.
  • All purchases are made at the risk of the Buyer, and it is the Buyer’s responsibility to investigate the Seller’s reputation and any applicable laws and regulations.

6. Point System

Intimates.no implements a point system that allows Sellers to identify potential Buyers based on their engagement with the Seller’s profile and listings. Points are awarded to Buyers for actions such as viewing listings, following Sellers, or adding items to their cart. When a Buyer reaches a certain point threshold, they will be marked as interested in the Seller and may be displayed on the Seller's “Hot Leads” page.

  • Sellers agree to adhere to the guidelines provided regarding the point system.
  • Buyers consent to the collection and use of data related to their actions for the purpose of awarding points.

7. Content Ownership and License

By posting Content on Intimates.no, you grant us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute such Content in any media. You represent and warrant that:

  • You own or have the necessary rights to post the Content.
  • The Content does not infringe upon any third-party rights, including intellectual property rights.

Intimates.no reserves the right to remove any Content that violates these Terms or is otherwise objectionable in our sole discretion.

8. Intellectual Property

All Content, trademarks, and other intellectual property on the Platform are the property of Intimates.no or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Platform without our express written consent.

9. Privacy Policy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our collection and use of your information as described in the Privacy Policy. The Privacy Policy can be found at intimates.no/pages/personvern.

10. Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis. Intimates.no makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, materials, or products included on it. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Intimates.no, its affiliates, officers, agents, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Intimates.no and its affiliates, officers, directors, agents, and employees from any claims, losses, liabilities, damages, expenses, or costs, including reasonable attorneys’ fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

13. Changes to Terms

Intimates.no reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes. We encourage you to review these Terms periodically for any updates.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Norway. Any disputes arising out of or related to these Terms or your use of the Platform shall be resolved in the courts located in Ringerike, Asker og Bærum tingrett.

15. Termination

Intimates.no reserves the right, in its sole discretion, to terminate your access to all or part of the Platform, with or without notice, for any conduct that we believe violates these Terms or is harmful to other Users or the Platform.

16. Prohibition on Sharing Links and Contact Information

Buyers and Sellers are prohibited from sharing links or contact information outside the platform. This is to protect the anonymity and safety of all users. Any attempt to circumvent this rule by communicating outside the platform will be considered a serious violation of our Terms and may result in immediate suspension from the platform. We take the safety of our users seriously and reserve the right to take action against users who do not comply with this provision.
